1. ABOUT THESE TERMS
These Terms of Service govern your use of the Goth Alpaca website and purchases made through it.

By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy and Refund & Return Policy.
Nothing in these Terms limits any mandatory rights that you have under applicable consumer law.
2. USE OF THE WEBSITE
You may use this website for lawful personal use and shopping.
You must not use the website in a way that is unlawful, fraudulent, harmful, abusive, infringes the rights of another person, interferes with the operation or security of the website, or attempts to gain unauthorised access to any system or account.
You must have the legal capacity required under applicable law to enter into a purchase contract.
3. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, measurements, colours, prices and other product information are accurate.
Colours can appear differently depending on display settings, lighting and photography.
Measurements may have reasonable manufacturing tolerances where applicable.
Nothing in this section permits us to supply goods that materially differ from their description or removes any rights you have if goods are defective or not as described.
Product availability can change without notice.
4. ORDERS
Placing an order constitutes an offer to purchase the products in your order.
After you place an order, we may send an acknowledgement confirming that the order has been received.
A purchase contract is formed when we accept your order.
We may be unable to accept an order for legitimate reasons including:
• a product becoming unavailable;
• an obvious pricing or listing error;
• inability to deliver to the supplied address;
• suspected fraud or unauthorised payment;
• failure of payment authorisation; or
• legal or regulatory restrictions.
If we cannot accept an order after payment has already been taken, the relevant payment will be refunded.
Please check your order and contact details carefully before submitting your order.
5. PRICES, TAXES AND PAYMENT
Prices are displayed in Euro unless another currency is specifically presented through the storefront.
Prices displayed through Goth Alpaca include applicable taxes where those taxes are required to be included in the displayed price.
Shipping charges are shown separately at checkout before you place the order.
Depending on the destination, customs duties, import taxes or other charges may apply where they are not collected at checkout. Further information is provided in our Shipping Policy.
We accept the payment methods displayed at checkout.
Payment must be successfully authorised before an order can be processed.
We may correct an obvious pricing or technical error. If an error affects an order already submitted, we will contact you and give you the appropriate options before proceeding where required.
6. SHIPPING AND DELIVERY
Shipping availability, processing times, estimated delivery periods and shipping charges are described in our Shipping Policy.
Delivery dates are estimates unless a specific guaranteed date is expressly agreed.
Where Goth Alpaca arranges or offers the carrier, responsibility for the goods remains with us until the goods are delivered to you or to a person nominated by you to receive them, subject to applicable law.
This does not apply in the same way where you independently instruct a carrier that was not offered by us.
7. RETURNS AND RIGHT OF WITHDRAWAL
Our return process is described in our Refund & Return Policy.
In addition to our voluntary 30-day return policy, consumers who are entitled to statutory withdrawal rights under EU or EEA law generally have 14 days after receipt of goods to notify us that they wish to withdraw from an online purchase without giving a reason.
Applicable statutory exceptions continue to apply.
Nothing in our voluntary return policy replaces, restricts or reduces a statutory right of withdrawal.
8. FAULTY OR NON-CONFORMING GOODS
Consumers in the European Union have a minimum two-year legal guarantee in relation to goods that are faulty or do not conform to the contract.
Depending on the circumstances and applicable law, remedies may include repair, replacement, a proportionate reduction in price or refund.
These legal rights exist separately from any voluntary return policy or commercial warranty.

9. PROMOTIONS AND DISCOUNTS
Promotions, discount codes and special offers may have additional conditions that are displayed when the promotion is offered.
Unless otherwise stated, promotions cannot be exchanged for cash.
A promotional condition does not remove any mandatory consumer rights.
We may withdraw or amend future promotions at any time, but this will not retrospectively remove a benefit that has already become part of an accepted order.
10. CUSTOMER ACCOUNTS
If you create a customer account, you are responsible for keeping your login information secure.
Please contact us if you believe your account has been accessed without your permission.
We may restrict or suspend an account where reasonably necessary to prevent fraud, misuse, security threats or unlawful activity.
11. REVIEWS AND USER CONTENT
If you submit a product review, photograph or other content to Goth Alpaca, you confirm that you have the right to submit it.
You grant us permission to display and reproduce that content for purposes connected with operating and promoting Goth Alpaca.
We may remove content that is unlawful, fraudulent, abusive, misleading, infringes third-party rights, contains personal information that should not be publicly displayed, or otherwise violates applicable rules.
Submitting a negative review will not by itself be a reason for removal.
12. INTELLECTUAL PROPERTY
The Goth Alpaca name, branding, website design and original content are owned by Wayward Gifts and Crafts Ltd. or used by us with appropriate rights or licences.
Third-party trademarks, photographs, designs and other intellectual property remain the property of their respective owners.
You may use the website for ordinary personal and non-commercial purposes.
You may not reproduce, sell, commercially exploit or falsely represent our branding or original website content without permission, except where applicable law permits such use.
13. THIRD-PARTY SERVICES
Our website is powered by Shopify and may use other third-party services for payments, reviews, fulfilment, analytics, communication and related functions.
Third-party services may have their own terms and privacy practices.
We remain responsible for our obligations to you as the seller where applicable law places that responsibility on us.
14. PRIVACY
Personal information is handled in accordance with our Privacy Policy and applicable data-protection law.
Our Privacy Policy explains how information is collected, used, shared and protected and how you can exercise applicable data-protection rights.
15. WEBSITE AVAILABILITY
We aim to keep the website available and accurate, but we cannot guarantee uninterrupted access at all times.
Maintenance, technical problems, security issues or circumstances outside our reasonable control may temporarily affect access.
We may update or improve the website from time to time.
16. LIABILITY
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Nothing in these Terms excludes or reduces:
• mandatory consumer rights;
• liability for fraud or fraudulent misrepresentation;
• liability for death or personal injury where exclusion is prohibited by law; or
• any other liability that applicable law does not permit us to exclude.
If you are purchasing as a consumer, we are responsible for losses that are a reasonably foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law.
We are not responsible for losses caused solely by events outside our reasonable control where applicable law permits this, although this does not remove any rights you may have to a refund, replacement or other statutory remedy.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to the business, website, services or applicable law.
The version applying to a purchase is generally the version in effect when the relevant order is placed, unless applicable law requires otherwise.
Material changes will not retrospectively remove rights that you already acquired under an existing contract.
18. SEVERABILITY
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
19. GOVERNING LAW AND CONSUMER RIGHTS
These Terms and contracts with Goth Alpaca are governed by the laws of the Republic of Cyprus.
If you are a consumer residing in another country and mandatory consumer-protection rules of your country apply to your purchase, this choice of law does not deprive you of protections that cannot legally be excluded by contract.
Nothing in these Terms restricts any right you may have under applicable law to bring a consumer claim before a court or competent authority available to you.
